Privacy Policy
AvSuite Lite is a service of Nicholl Aviation LLC (“AvSuite Lite,” “we,” “us,” or “our”). This Privacy Policy explains how we collect, use, disclose, store, and protect personal information in connection with the AvSuite Lite website, applications, software, and related services (collectively, the “Services”).
1. Information We Collect
Account and Profile Information
We may collect names, email addresses, telephone numbers, account identifiers, organization affiliation, role, authentication information, profile details, notification preferences, and account settings.
Organization and Membership Information
We may process organization names, administrators, owners, members, invitation records, role assignments, home airport or location, membership status, and organization settings. An organization may provide an invitee’s email address to send or create a registration invitation.
Aircraft and Operational Information
We may process aircraft identifiers and descriptions, photos, meter values, reservations, dispatch and return information, maintenance and inspection items, squawks, availability, aircraft status, documents, POH files, and related activity entered by users.
Financial and Account Information
We may process shared expenses, flight charges, member balances, payment records, account entries, descriptions, dates, and related organization financial records. Payment-card transactions may be processed by a third-party payment processor. AvSuite Lite may receive subscription status, transaction identifiers, billing contact information, payment status, and limited payment-method details, but does not ordinarily receive or store complete payment-card numbers.
Uploaded Content
Users may upload files, photographs, documents, and notes that contain personal or aviation-related information. Users and organizations should upload only information reasonably necessary for their use of AvSuite Lite and that they are authorized to provide.
Technical and Usage Information
We may automatically collect IP address, device type, browser type, operating system, login activity, pages and features accessed, error and diagnostic information, security logs, email-delivery status, and approximate location derived from an IP address.
2. Information Provided by an Organization
AvSuite Lite often receives information because an aircraft partnership, flying club, administrator, owner, or other organization uses the Services. In these circumstances, the organization generally determines who is invited, what information is entered, which users can access it, and how it is used within that organization’s environment. Questions about organization-controlled records may need to be directed to the organization.
3. How We Use Information
We may use information to provide and maintain the Services; create and authenticate accounts; send registration invitations and service messages; manage organizations, aircraft, owners, administrators, and members; provide scheduling, dispatch, maintenance, document, billing, reporting, and administrative functions; process subscriptions; protect accounts and systems; detect fraud, abuse, and unauthorized access; troubleshoot problems; deliver support; improve and develop AvSuite Lite; comply with legal obligations; and enforce applicable agreements and policies.
4. Organization Records and Ownership
AvSuite Lite does not claim ownership of organization, aircraft, member, maintenance, scheduling, or financial records merely because they are stored through the Services. We do not sell individual organization records to advertisers. Organizations and users remain responsible for the accuracy, lawful collection, and appropriate use of the information they enter.
5. Legal Bases
Depending on the jurisdiction and circumstances, information may be processed to perform a contract, provide requested Services, pursue legitimate business interests, with consent, comply with legal obligations, or for other purposes permitted by applicable law. Where consent is legally required, users may have the right to withdraw it subject to applicable requirements.
6. How Information Is Shared
Within an Organization
Information may be accessible to authorized owners, administrators, members, or other users within the organization associated with an account, depending on permissions and functionality.
Service Providers
We may use providers for cloud hosting, database infrastructure, authentication, file storage, payment processing, email delivery, analytics, security, error monitoring, and customer support. Providers may process information as necessary to perform services for AvSuite Lite subject to applicable agreements and law.
Legal Requirements and Safety
We may disclose information when reasonably necessary to comply with law or valid legal process, protect the rights or safety of AvSuite Lite or others, investigate fraud or security incidents, enforce agreements, or address an urgent threat.
Business Transactions
If AvSuite Lite or Nicholl Aviation LLC is involved in a merger, acquisition, financing, restructuring, or sale of some or all of the business, information may be transferred as part of that transaction subject to applicable law.
7. Sale of Personal Information
AvSuite Lite does not sell personal information in the ordinary meaning of selling information for monetary payment. If our practices change in a way that creates additional rights under applicable privacy law, this Policy will be updated and required choices will be provided.
8. Cookies and Similar Technologies
We may use cookies, local storage, authentication tokens, and similar technologies to keep users signed in, maintain sessions, remember preferences, protect account security, measure application performance, and understand feature use. Some technologies are necessary for operation and security.
9. Data Retention
We retain information for as long as reasonably necessary to provide the Services, fulfill contractual obligations, comply with legal requirements, resolve disputes, maintain security, and enforce agreements. Retention periods vary by information type and relationship. Organizations are responsible for their own legal and operational retention obligations, and AvSuite Lite should not be considered the sole archival repository for required aircraft, maintenance, tax, accounting, or business records.
10. Account Closure and Export
After account closure, certain information may remain temporarily in backups, security logs, transaction records, or other systems where retention is reasonably necessary. Information may also be retained where required by law or necessary to establish, exercise, or defend legal claims. Organizations should export records they must retain before closing an account when export functionality is available.
11. Data Security
AvSuite Lite uses reasonable administrative, technical, and organizational safeguards intended to protect personal information. Safeguards may include access controls, authentication, encrypted communications, database and storage security, logging, backups, and service-provider controls appropriate to the Services. No system can guarantee absolute security. Users are responsible for protecting passwords, devices, email accounts, invitation links, and authentication credentials.
12. Security Incidents
If AvSuite Lite becomes aware of a security incident involving personal information, we will investigate and respond as reasonably appropriate. Where required by law, we will notify affected individuals, organizations, or governmental authorities.
13. Access, Correction, and Deletion
Depending on applicable law, individuals may have rights to request access, correction, deletion, a copy of certain information, restriction of processing, or other privacy rights. When information is controlled by an organization, AvSuite Lite may direct the individual to that organization or assist the organization in responding. Some records may need to be retained where permitted or required by law. Requests may be submitted to support@avsuitelite.com.
14. Children’s Privacy
AvSuite Lite is not directed to children under 13 and does not knowingly seek to collect personal information directly from children under 13 in violation of the Children’s Online Privacy Protection Act. Organizations are responsible for determining whether parental or guardian consent is required before inviting a minor or entering information about a minor. If we learn that information was collected in violation of applicable law, we will take appropriate steps.
15. Third-Party Services and International Users
Third-party services linked to or used with AvSuite Lite have their own privacy practices. Information may be processed and stored in the United States or other locations where AvSuite Lite or its providers operate. Where required, appropriate safeguards will be used for international transfers.
16. Changes to This Policy
We may update this Policy as the Services, technology, business, or legal requirements change. The “Last Updated” date identifies the current version, and material changes may receive additional notice when required by law.
